Terms of Service

These Terms of Service ("Terms") govern your access to and use of konvyrt.com (the "Site") operated by Konvyrt LLC ("Konvyrt," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Services
Konvyrt provides digital marketing services to home service companies, including brand identity, website design and development, social media management, paid advertising, and content creation. The specific scope, deliverables, timelines, and pricing for any client engagement are governed by a separate written agreement between Konvyrt and the client. These Terms apply to general use of the Site and do not modify the terms of any client agreement.
2. Use of the Site
You may use the Site for lawful purposes only. You agree not to:
- — Use the Site in any way that violates applicable law or regulation
- — Attempt to gain unauthorized access to any part of the Site or its underlying systems
- — Interfere with, disrupt, or place undue load on the Site or its servers
- — Scrape, copy, republish, or otherwise commercialize Site content without our written permission
3. Intellectual Property
All content on the Site — including text, graphics, logos, images, video, and software — is the property of Konvyrt LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. The "Konvyrt" name and logo are trademarks of Konvyrt LLC. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission.
4. Third-Party Services
The Site embeds third-party services, including the Cal.com scheduling widget. Use of these services is subject to their own terms and privacy policies. Konvyrt is not responsible for the availability, accuracy, content, or practices of third-party services.
5. Disclaimers
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Konvyrt does not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.
Marketing services involve creative judgment, market dynamics, and external factors outside Konvyrt's control. Konvyrt does not guarantee specific business outcomes — including but not limited to a specific number of leads, conversions, search rankings, or revenue — from any service we provide.
6. Limitation of Liability
To the fullest extent permitted by law, Konvyrt LLC, its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services.
Our total aggregate liability for any claim arising from or related to these Terms or your use of the Site shall not exceed the amount you paid Konvyrt in the six (6) months preceding the claim, or one hundred dollars ($100), whichever is greater.
7. Indemnification
You agree to indemnify, defend, and hold harmless Konvyrt LLC, its members, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, violation of these Terms, or infringement of any third-party rights.
8. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for conduct we believe violates these Terms or is otherwise harmful to Konvyrt or other users.
9. SMS Communications
Konvyrt LLC may send SMS messages to contracted business clients as part of its lead intake and notification services. By signing a service agreement with Konvyrt LLC, the client (recipient) authorizes Konvyrt LLC to send transactional SMS lead notifications to the client's designated business phone number.
These SMS messages are sent for the purpose of notifying the client of new lead inquiries captured via Konvyrt-managed channels (website contact forms, paid advertising lead forms, and similar). Message content typically includes the lead's name, phone number, email address, and source attribution.
The client may revoke SMS consent at any time by replying STOP to any message, by emailing konvyrt@konvyrt.com, or by terminating the underlying service agreement. Konvyrt's SMS communications comply with applicable carrier and CTIA guidelines, and Konvyrt registers SMS campaigns under the A2P 10DLC framework through its SMS service provider (Twilio).
Standard message and data rates from the recipient's carrier may apply to all SMS communications.
10. Governing Law and Disputes
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of laws principles. Any dispute arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in Hennepin County, Minnesota, and you consent to the personal jurisdiction of those courts.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
